By using the infinite Group Ltd (infinite) website (jobs.infinitegroup.co.uk) and the services available you are deemed to have accepted these Terms & Conditions and any additional Terms & Conditions stipulated by any 3rd Party.

The infinite website is provided for the purpose of a conduit for individuals seeking work and clients assisting in the support of recruitment.

These Conditions are deemed accepted by the Job Seeker when the Services of infinite have been accessed and used by the Job Seeker.

1. Definitions

1.1 In these Conditions the following words and phrases shall have the following meanings unless the context requires otherwise :-

Advertisement	Any Advertisement for the purpose of recruitment including Banners, Jobs by Email and/or any page(s) of Client advertising together with any other form of Advertisement that shall appear on the Site from time to time
Advertising Agency	A Client who is directly or indirectly providing the Services on to an End Client;
Applicant	An individual (Job Seeker) who applies for a vacancy advertised on the Site;
Application	An on line application made by a Job Seeker to a vacancy advertised on the Site;
Campaign Work	Campaign work is a provision of Field Marketing which allows the ‘client’ to market their brand and / or establish how well their brand is doing within the market place. infinite Group book Subcontractors to carry out activities on an activity-by-activity basis. Subcontractors support short-term field marketing activities across the UK.
Client	Any person using and purchasing the Services of the site; a person includes (but not limited to) Direct Employers, Recruitment Agencies and Advertising Agencies. In the circumstance of any Recruitment or Advertising Agency acting on behalf of one of their own End Clients, infinite will charge the Agency and not the Agency's End Client;
Conditions	These Standard Terms and Conditions;
Contract	The contract for the supply of any Services to the Client by infinite which comprises of these Conditions and a Service Agreement;
CV	The curriculum vitae or brief outline detailing a Job Seeker's employment experience, education, training and skills, provided to infinite by a Job Seeker for distribution to Clients with a view to securing employment;
CV Search	A Search facility which allows the Client to search for and view CVs online using various search criteria;
Direct Employer	A Client who is receiving the Services of infinite for the purpose of their own recruitment needs and not on behalf of any other 3rd party End Client;
End Client	The person/company to whom the Client's services are provided;
infinite Group Ltd. (infinite)	infinite Group Ltd. Limited (company number 05253964);
Job Seeker	An individual who uses the Site for the purpose of finding employment, (permanent or campaign);
My Account	A personalised page of the Site where a Job Seeker may access and edit their own personal details, upload and manage their CV and other services;
Recruiter	Any person working on behalf of the Advertising Agency, Direct Employer or Recruitment Agency Client and who is authorised by the Client to use the Services;
Recruitment Agency	An Employment Agency or Employment Business as defined by the Employment Agencies Act 1973 (and all regulations made there under);
Registration	the process a Job Seeker completes in order to store and save their details, CV and covering letter on infinite for the purpose of securing suitable permanent or registering for campaign work;
Services	The Services which infinite has agreed to provide to the Client and includes Advertisements, CV Search, Application Manager and any other Services which may be provided to the Client and made available for viewing by Job Seekers;
Service Agreement	The Service Agreement entered into between the Client and infinite;
Site	The Site at jobs.infinitegroup.co.uk or any other website on which any Advertisement appears and any other websites owned or controlled by infinite;

In these Conditions:

- references to any statute or statutory provision shall, unless otherwise stipulated, be construed as a reference to that statute or statutory provision;

- references to the masculine include the feminine and the singular include the plural, etc and vice versa as the context requires;

- the wording ‘persons’ includes individuals, companies, and corporate bodies.

2. Application of the Terms

2.1 These Conditions to the exclusion of all previous terms and conditions issued by infinite shall apply to any Job Seeker who uses infinite after the date on which these Conditions were posted on the Site.

2.2 These Conditions are deemed to be fully read, understood and accepted by the Job Seeker upon acceptance of these Conditions during Registration, or in the case of a Job Seeker who has not completed Registration, when an Application is made.

2.3 No variation or alteration to these Conditions or any representations about the Services shall have any effect unless expressly agreed and confirmed in writing by a board director of infinite.

3. Services Generally

3.1 infinite does not make any representation whatsoever about any Advertisement accessed either on, by virtue of or by way of any links from the Site nor about any of the Clients who use Services on the Site. infinite relies on information provided to it by Clients and via third parties and accordingly it is a matter for the Job Seeker to satisfy their self as to the suitability of any Client using Services on the Site or of any Advertisement found directly or indirectly through the Site.

3.2 infinite shall be entitled at anytime without notifying the Job Seeker to make changes to the Services which are necessary to comply with any security or statutory requirements and shall determine the manner in which the Services are provided.

3.3 infinite is the owner or the licensee of all intellectual property rights in our site, and in the material published on it. Such intellectual property rights include (without limitation) copyrights database rights, registered designs, unregistered design rights, registered trade marks, passing-off rights or rights protected under unfair competition laws. All such rights are reserved.

3.4 If in the unlikely event of a technical fault or reasons beyond the control of infinite we would hope to resolve these circumstances as quickly and reasonably as possible, but you agree that we shall have no financial liability to you in the event of such unavailability.

3.5 The Job Seeker accepts that infinite shall not be liable for any failure to provide the Services (or any part thereof) as a result of the Job Seeker's failure to comply with these Conditions.

3.6 The Job Seeker agrees to provide infinite, in such a format as infinite may request, any information necessary to enable infinite to provide those Services.

3.7 infinite shall not be obliged to provide those Services until the Job Seeker has supplied it with the information, necessary to provide those Services.

4. Jobs by Email

If the Job Seeker has signed up to receive Jobs-By-Email, the provisions of this clause 4 shall apply thereto.

4.1 Jobs-By-Email are sent to Job Seekers with search criteria matching vacancies on this Site posted or renewed since the last Jobs-By-Email sent to the Job Seeker and matching the Job Seeker's search criteria.

4.2 The Job Seeker accepts that infinite cannot guarantee the number of vacancy Advertisements posted to the Site and sent via the Jobs-By-Email service and there are no obligations on infinite in this regard.

5. CVs

If the Job Seeker has saved their details and stored a CV on infinite, the provisions of this clause 5 shall apply thereto.

5.1 The Services are subject to any instructions from a Job Seeker that his or her details should or should not be made available to the Client. infinite will only make available or supply copies of the CVs received by the Job Seeker for distribution to Clients of infinite for the purpose of securing suitable employment.

5.2 infinite cannot guarantee the minimum number of times a CV will be viewed by Clients.

5.3 infinite may, at its discretion and without notice, report improper or illegal use of CVs by the Job Seeker to its Clients.

5.4 infinite has the right at its sole discretion to decline to distribute or forward, or remove any Job Seeker information or CV.

5.5 infinite may refuse, withdraw, or require to be amended, any Job Seeker information or CV which is illegal, immoral, obscene or offensive.

5.6 The Job Seeker undertakes that:

5.6.1 The details and CV they store and save on infinite are a true and accurate reflection of their education, employment, training history and that their personal details are correct;

5.6.2 That if any of the information stored and saved on infinite for the purposes of securing employment is found to be false or inaccurate in any way, that infinite reserves the right to remove those details and/or suspend the use of the Services on the Site for the Job Seeker;

5.6.3 In respect of any information or CV submitted by the Job Seeker which contains the name or pictorial representation (photographic or otherwise) of any living person and/or any part of any living person and/or any copy by which any living person is or can be identified the Job Seeker has obtained the authority of such living person to make use of such name, representation and/or copy;

5.7 By registering their details for the purpose of conducting Campaign work, the Job Seeker agrees for infinite to pass their details on to third party companies.

6. Job Seekers Obligations

6.1 The Job Seeker agrees that:

6.1.1 They have read, understood and agrees to the Privacy Statement on the Site;

6.1.2 They will keep confidential and not disclose to any person the password used by them in relation to the Services;

6.1.3 They will be responsible for any misuse of all such passwords.

7. Liability

7.1 infinite will not be liable (whether in contract or tort) for:

7.1.1 Any loss of copy, artwork, photographs, data, CVs or other materials that the Job Seeker supplies to infinite;

7.1.2 Any mistakes, errors, loss or damage that arise during the course of use of the Services as a result of circumstances beyond its reasonable control or as a result of the acts or omissions of the Job Seeker;

7.1.3 For any failure to secure employment (whether caused by the negligence of infinite, its employees or agents);

7.1.4 Any delay, costs, expense, loss, damage or liability howsoever caused arising from any matter beyond the reasonable control of infinite or as a result of the acts or omissions of the Job Seeker;

7.1.5 Any loss or damage whatsoever howsoever caused arising out of the acts by any Client. The Job Seeker must satisfy itself as to the integrity and reliability of all vacancy Advertisements placed on the Site;

7.1.6 Any breach of agreement, infringement or violation of any right of any person or be rendered liable to any proceedings whatsoever, as a result of any information , CV or Application  submitted by the Job Seeker and the Job Seeker indemnifies infinite against all costs, claims, damages, loss, expenses and liabilities suffered or incurred by infinite as a result.

7.2 Nothing in these Conditions will restrict or exclude infinite's liability for death or personal injury caused by its own negligence.

7.3 The Job Seeker agrees and acknowledges that no condition, warranty or representation of any kind is, has been, or will be, given by or on behalf of infinite in respect of or in connection with the Services.

8. Termination and Cancellation

8.1 These Conditions apply unless replaced by subsequent Conditions.

8.2 Either party may, at its sole discretion, terminate the provision of the Services to the Job Seeker at any time by notice in writing, if the Job Seeker is in breach of these Conditions and fails to remedy such breach within 14 days of infinite requesting it to be remedied.

8.3The Job Seeker shall be responsible for all reasonable costs, claims, damages, loss, expenses and liabilities incurred by infinite arising out of the Job Seeker's breach of its obligations under these Conditions (including, without limitation, on a solicitor and own client basis, any legal fees and disbursements reasonably incurred by infinite).

9. Notices

9.1 Notice required or permitted to be given under these Conditions shall:

9.1.1 Be in writing and addressed to the other party at its registered office or other relevant address; or

9.1.2 Be in the form of an email addressed to infinite at jobs@infinitegroup.co.uk (or such other address as supplied by infinite) or if to the Job Seeker, to the address provided in the Job Seeker's details submitted during Registration or as subsequently amended.

9.2 The Job Seeker is responsible for notifying infinite of any changes to its email address. Such notification shall request an acknowledgement of receipt and shall be confirmed in writing and sent to infinite by email.

10. General

10.1 If any provision of these Conditions shall be invalid or unenforceable, it shall not affect any other provision, which shall remain in full force and effect.

10.2 Any waiver by infinite of any breach of, or any default under, any provision of these Conditions by the Job Seeker will not be deemed to be a waiver of any subsequent breach or default and will in no way affect the other terms of these Conditions.

10.3 Failure or delay by infinite in enforcing or partially enforcing any provision of these Conditions will not be construed as a waiver of any of its rights under these Conditions.

10.4 The parties to these Conditions do not intend that any clause of these Conditions will be enforceable by virtue of the Contracts (Rights of Third Parties) Act 1999 by any person that is not a party to it.

11. Law

11.1 These Conditions and any contract into which these Conditions are incorporated, shall be governed by and construed in accordance with English law and the parties submit to the non exclusive jurisdiction of the English courts.

12. infinite Agency Policy

12.1 infinite Group has a commitment to sourcing candidates directly and as such we do not accept speculative CV's from agencies. We do however, work with a defined list of preferred suppliers who may be invited to support us in sourcing candidates for particular roles, but in line with our Preferred supplier list, we only pay agency fees where we have a signed agreement in place and an agency has been instructed by a member of the infinite recruitment team. We do not pay agency fees where speculative and unsolicited CV's are sent to infinite or infinite employees by any means other than through our recruitment portal. Where this is not observed infinite reserves the right to contact these candidates directly and initiate discussions without payment of any agency fee. Submission of any unsolicited CV's and proposals to infinite will be deemed evidence of full and unlimited acceptance of this Agency policy.
